Privacy Policy

Effective Date: September 3, 2026

1. Introduction

Tracey Cabanis, Attorney at Law, PLLC ("Firm," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through attorneytracey.com (the "Site") and when you contact our office by phone, email, text message, or web form; how we use that information; and the choices available to you. By using the Site or contacting our office, you agree to the terms of this Privacy Policy.

2. Information We Collect

We may collect information you voluntarily provide, including:

We do not knowingly collect sensitive information — such as Social Security numbers, financial account numbers, or dates of birth — through this Site, and we ask that you not include this type of information in any web form or email to us.

3. How We Use Information

Contacting the office through this Site, by phone, or by text message does not create an attorney-client relationship. An attorney-client relationship is formed only when the Firm and a client sign a written engagement agreement.

4. How We Share Information

We do not sell your personal information. We may share information with:

We do not share your information with third parties for their own marketing or advertising purposes.

5. Text Messaging (SMS) Communications

If you provide a mobile phone number to our office and opt in to receive text messages, the following terms apply:

  • Program description. Text messages from our office may include appointment and court date reminders, requests for documents, and follow-up on an inquiry you submitted. We do not send marketing text messages.
  • Consent. You will only receive text messages from us if you have provided express consent — for example, by submitting your number through a form on this Site, providing it during a phone call, or signing an engagement agreement that includes text messaging consent. Consent to receive text messages is never a condition of retaining our office or purchasing any services.
  • Message frequency varies depending on your matter, and will typically range from one to a few messages around a court date or deadline.
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt out. You may opt out of text messages at any time by replying STOP to any message you receive from us. You will receive one final message confirming that you have been unsubscribed. You may also opt out by calling our office at (954) 644-1352 or emailing Info@AttorneyTracey.com.
  • Help. Reply HELP to any message for assistance, or contact us using the information above.
  • Carriers are not liable for delayed or undelivered messages.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing information with subcontractors that support our services (such as our case management or text messaging platform providers), for the purpose of providing those services, is permitted. All text messaging originator opt-in data and consent will not be shared with any third parties, regardless of category, for any purpose.

6. Phone Calls

If our office records or retains audio of phone calls, we will disclose that at the start of the call, consistent with Florida's all-party consent law (Fla. Stat. §934.03). If you would prefer not to be recorded, let us know and we will proceed without recording.

7. Cookies and Analytics

The Site may use basic cookies or similar technologies to understand how visitors use the Site, such as aggregate page-visit analytics. We do not use this data to build advertising profiles about you, and we do not sell it.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

This Site is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

10. Your Choices

You may decline to provide information to us, though this may limit our ability to respond to your inquiry. You may opt out of text messages as described in Section 5, and you may ask us to delete contact information you have submitted through the Site by emailing Info@AttorneyTracey.com, subject to our recordkeeping obligations under the Florida Rules of Professional Conduct.

11. Changes to This Policy
